GENERAL TERMS & CONDITIONS OF SALE
The present General Terms and Conditions of Sale apply to any and all orders placed on the MAKE UP FOR EVER e-commerce website a delivery in Belgium, Germany, Italy, Netherlands, Poland, Spain.
WHO WE ARE
MAKE UP FOR EVER SA (hereinafter « MAKE UP FOR EVER ») is a company engaged in the creation and distribution of cosmetics products under the trademark MAKE UP FOR EVER.
Complementary to MAKE UP FOREVER’s network of selected retail outlets and Boutiques, in which the products are sold, MAKE UP FOREVER has wished to implement its own online sales website. MAKE UP FOREVER trades products on its website solely for individual Consumers. Any order not corresponding to a retail sale and any fraudulent or assumedly fraudulent order shall be treated by MAKE UP FOREVER as void and shall not be processed.
The Customer’s particular attention is drawn to Article 13 (MAKE UP FOR EVER’S liability to the Customer).
1. DEFINITIONS
“Consumer" means (i) an individual and (ii) someone acting wholly or mainly outside of their business, trade, craft or profession, for own personal use.
"Contract" means the contract made between the Parties each time an order is finalised under Article 6 of these General Terms and Conditions of Sale.
“Customer(s)” means the Internet user(s) browsing the e-commerce website and making an online purchase of Product(s) for personal use.
“MAKE UP FOR EVER” means MAKE UP FOR EVER SA, with a share capital of €1,050,000 registered with the Trade and Companies Register of Paris under the number 318 309 267, whose registered office is located at 5 rue La Boétie - 75008 PARIS - France.

Mrs Gabrielle Rodriguez Saint-Genis, as CEO of MAKE UP FOR EVER, is the publishing director.
“General Terms and Conditions of Sale” means these general terms and conditions applying to any and all sales of Products presented on the website.
“Party(ies)” means collectively or individually MAKE UP FOR EVER and/or the Customer(s)/ Professional Client(s).
“Product(s)” means all cosmetic products bearing the MAKE UP FOR EVER brand name, which are presented for sale on the website.
“Website” means the MAKE UP FOR EVER online sales website, which is accessible www.makeupforever.com/fr/fr/ and www.makeupforever.com/eu/en/, and offers the Products for sale.
2. SCOPE OF THE GENERAL TERMS AND CONDITIONS OF SALE
These General Terms and Conditions of Sale set out the terms and conditions under for the online sale of Products by MAKE UP FOR EVER to Customers, as well as the Parties ‘rights and obligations arising from the online sale of Products offered on the Website.
The General Terms and Conditions of Sale can always be found by the Customer on: www.makeupforever.fr and shall be communicated to the Customer on simple request by phone on +33 1 41 43 13 19, email via the contact form available at www.makeupforever.com/eu/en/contactus via or by post to the following address: MAKE UP FOR EVER - Customer Relations Department - 1 rue Pasquier, 92300 Levallois-Perret.
By placing an order for a Product offered on the Website, the Customer recognizes – by ticking the box “By validating your order, you accept the General Terms and Conditions of Sale” – that he/she has been fully informed on and accepted such General Terms and Conditions of Sale without limitation before placing his/her order. This acceptance is in no way conditioned by a handwritten signature of the Customer.
It is specified that the Customer may, at any time, save or print these General Terms and Conditions of Sale, provided that he/she does not modify them. Please note that a copy of the latter will be sent to the Customer with the confirmation email of order.
MAKE UP FOR EVER reserves the right to amend, at any time, the General Terms and Conditions of Sale. In the event of an amendment of the General Terms and Conditions of Sale, the General Terms and Conditions of Sale applicable are those in force on the date of the order.
The General Terms and Conditions of Sale shall apply without limitation to any sale of Products on the Website, excluding any other document and particularly the conditions applicable to sales in stores or through any other distribution and marketing channel.
3. PRODUCTS
1. Products description
The Products offered for sale by MAKE UP FOR EVER are those presented on the Website at the date of connection of the Customer, within the limits of available stocks. MAKE UP FOR EVER reserves the right to withdraw Products from sale at any time.
MAKE UP FOR EVER puts the utmost care in the presentation of the Products on the Website. However, pictures illustrating the Products shall only be for information and are not contractual.
Indeed, while MAKE UP FOR EVER makes its best efforts to ensure that the colour of the Products – whose photos are displayed on the Website – are faithful to the original, variations may occur (including slight differences in colours and proportions), particularly given the technical limitations of colour renderings of computer equipment. Consequently, MAKE UP FOR EVER shall not be responsible if the Product varies from those images. The packaging of Products may vary from that shown in images on the Website.
For any question or concerns regarding the order and appropriate use of Products, the Customer may contact MAKE UP FOR EVER Customer Service:

2. Products availability
The Products displayed on the Website are offered for sale within the limit of available stocks. MAKE UP FOR EVER does not guarantee the availability of the Products displayed on the Website. In the event of the unavailability of one or several Product(s) after an order is completed, MAKE UP FOR EVER will inform the Customer at the earliest by email or telephone of the unavailability of the Product(s) and the partial or full cancellation of his/her order.
Should the order be totally cancelled for unavailability, the Customer’s order shall be automatically cancelled, and his/her bank account will not be charged.
Should the order be partially cancelled for unavailability:
- The Customer’s order will be validated, and his/her bank account will be charged only with the amount of the Products actually sent,
- The Customer will be informed at the earliest by email or telephone of the unavailability of the Product(s) concerned,
- The Customer will receive the available Products.
3. Products personalization service
MAKE UP FOR EVER offers a personalization service for some Products. The personalized content must not be defamatory, abusive, illicit or discriminatory. In such event, MAKE UP FOR EVER reserves the right to cancel the corresponding order.
4. PRICE
All Products prices are firm. Prices are given in euros all taxes included. The price in force is the one indicated for each Product on the Website.
These prices include all taxes applicable on the day of the order but exclude any packaging and delivery costs, which will be charged additionally and will be specified to the Customer prior to the order being finalised. Delivery costs will be indicated to the Customer before the validation of the order. The present General Terms and Conditions of Sale provide various delivery methods, which may be modified at any time by MAKE UP FOR EVER.
The invoiced price is the price indicated to the Customer on the order confirmation page, which appears on screen at the order confirmation and is sent by MAKE UP FOR EVER to the Customer by email.
MAKE UP FOR EVER reserves the right, and the Customer accepts, to modify the price of the Products at any moment, without any further formalities than to make the changes available on the Website. These changes may not affect the orders validated by the Customer prior to the coming into force of these changes, subject to the availability of the Products ordered.
5. RESERVATION OF OWNERSHIP
The Products ordered shall remain the property of MAKE UP FOR EVER until complete payment of their value to MAKE UP FOR EVER, including the main value of Products, as well as any costs and taxes included in the invoices/receipt, and the applicable delivery costs.
6. ORDER MODALITIES
1. Browsing the Website
While browsing the Website, the Customer sees the various Products offered for sale on the day of the visit of the Website. Browsing various pages of the Website constitutes in no way an order.
2. Order registration
MAKE UP FOR EVER only sells Products via the Website to Consumers. Products are solely intended for the Customer personal use, excluding any connection to his/her professional capacity. As a consequence, any order exceeding four (4) units bearing the same reference shall not be accepted as it is not presumed to correspond to the consumption and personal use of a Customer
In the event of an order of Products exceeding this maximum, the order shall be considered as null and will not be taken into account by MAKE UP FOR EVER.
To place an order on the Website, the Customer must be of legal age, have legal capacity and hold a credit card.
3. Order process
To place an order, the Customer must proceed to the following steps:
- Fill in the virtual shopping bag by clicking on the icon “Add to cart” or “Express Purchase” and indicating the Products concerned.
- Click on the button “Finalize my order”. Check and modify, as the case may be, the content of the virtual shopping bag, then click on the button “Finalize my order”.
- Select or refuse a free sample (within the limit of available stock). In accordance with the provisions of Article 6 below. In the event that the samples requested at the time of ordering are unavailable, they may be replaced by MAKE UP FOR EVER, at its discretion.
- Enter the delivery address.
- Log in on the Website : Customer shall identify herself/himself on the Website, either by creating an account on the Website by clicking on the "Create an account" button and completing a form (some fields are mandatory to take into account your order); or by logging on the Website by clicking on the "My account" button and entering your e-mail address and password if you have already created an account; or in guest mode: without creating an account but with the appropriate form fulfilled.
- Fill in the identification form on which the Customer indicates all the personal details requested (complete identity, email address, telephone number, delivery address). In the event that the invoice address and the identification details are the same as the details already given for delivery, validate the pre-filled fields with these details. Otherwise, indicate the invoice address and the identification details if they are different. Please refer to MAKE UP FOR EVER’s “Privacy Policy” for details on how MAKE UP FOR EVER collects and processes Customer personal data.
- Tick the box “By validating your order, you accept the General Terms and Conditions of Sale”. Until the “Proceed to payment” step, the Customer has the possibility to modify his/her order by clicking on the "Previous step" icon at the top and bottom left of the screen to:
- check the details of the order and its total price;
- return to previous pages to correct any errors in data entry or modify your order.
As the Customer confirms his/her order by clicking on the “Proceed to payment” icon, the Customer can no longer modify or cancel his/her order before proceeding to payment
At the end of the ordering process, the Customer is asked to click on the “Proceed to payment” icon. By clicking on, the Customer is redirected to the payment service provider Cybersource and proceed to payment following the conditions requested (credit card: Visa, Mastercard, American Express exclusively, PayPal or Apple Pay) – please refer to Article 8 below (Payment terms) for more information. This does not constitute MAKE UP FOR EVER’s acceptance of the Customer’s order and a Contract between the Parties is not formed until the order is validated by MAKE UP FOR EVER as explained under Article 6.4 below.
4. Final validation of the order - How is a contract formed ?
Following the validation of the payment by the Customer, a confirmation of the order will be sent by email to the Customer by MAKE UP FOR EVER. The order confirmation includes the summary of the Products ordered, the price, the delivery costs and the order number. It mentions the right of cancellation and includes the standard cancellation form. The order invoice is sent with the shipping email in PDF format.
The sale shall only be considered as definitive after the Customer validated the payment and received the order confirmation by email from MAKE UP FOR EVER.
The validation of payment by the Customer and the order confirmation email sent by MAKE UP FOR EVER constitute evidence of the acceptance of the order and its definitive validation and a Contract is formed between the Parties. These elements worth chargeability of the sums engaged by the selection of the Products on the order.
5. Order refusal
MAKE UP FOR EVER reserves the right to refuse any order in the event of:
- Number of Products ordered exceeds the maximum provided in the present Article 6.2;
- Litigation with the Customer;
- Total or partial non-payment of a previous order by the Customer;
- Refusal of authorization of payment per credit card by payment agencies including CyberSource, which is the payment service provider used by MAKE UP FOR EVER to detect credit card frauds;
- Request for personalization which does not comply with the provisions of Article 5.3;
- Abnormal nature of the order, particularly regarding quantities and/or amounts which does not correspond to the personal use of a final consumer.
6. Samples
Any order may be accompanied by a free sample within the limits of available stocks, if the Customer expresseviley asks to receive such samples. Orders over €50 are entitled to two free samples. Orders over €100 are entitled to three free samples. In the event of unavailability of the samples requested during the order, they may be replaced or cancelled by MAKE UP FOR EVER without prior notification to the Customer.
7. ARCHIVING AND PROOF OF THE CONTRACT
Communication between the Parties is done by email, which is accepted by the Customer. The storage of the order on MAKE UP FOR EVER's computer systems, the order confirmation and any communication between the Parties shall be considered as evidence of the Contract.
The computerized records stored in the computer systems of MAKE UP FOR EVER and its partners shall be considered as evidence of any communications, orders and payments between the Parties.
Any order which amount exceeds a hundred twenty (120) euros shall be archived by MAKE UP FOR EVER for a ten (10) years period from the last delivery. The Customer has the possibility, at any time, to access the details of his/her order(s) by sending an e-mail to Customer Service via the contact form available at www.makeupforever.com/eu/en/contactus
8. PAYMENT
The Customer pays the order after final validation of the latter on the Website, by debit or credit card (Visa, Mastercard, American Express exclusively), PayPal or Apple Pay.
Payment by Paypal
At the time of order validation, the Customer chooses the "Paypal" payment option and is automatically redirected to the "Paypal" platform. The Customer will then have to connect to their "Paypal" account using their login details. The Customer will also have the option of creating a “Paypal” account at this time if the client does not already have one. After validating their order with "Paypal", the Customer will be redirected to the confirmation page of the Website.
Payment by Apple Pay
- On-site payment accessible by Apple computer: Consumer identification with their Apple ID and payment
- On-site payment accessible by Iphone: Press the side button twice and confirm payment with Face ID authentication
Payment by credit card
At the time of order validation, the Customer chooses credit card payment option, the Customer enters his/her credit card number, the expiration date of the credit card, the name of the cardholder and the card security code (the last three or four numbers on the back of the credit card).
Payment is made by using the secured server of the payment service provider Cybersource (see below for more information). This means that none of the Customer’s bank information is processed on the Website. The payment by credit card is completely secured.
Any and all orders are payable in euros, including all taxes and mandatory contributions.
The credit card is charged at the time of dispatch of the order.
Cheque payments are not accepted.
The Customer guarantees MAKE UP FOR EVER that he/she has the authorizations required to use the chosen method of payment at the time of the order validation. In case of refusal of the bank, the order will be automatically cancelled and MAKE UP FOR EVER will not be responsible for the Customer’s order being cancelled.
Purchase invoices will be sent by e-mail to the e-mail address indicated by the Customer when placing his order on the MAKE UP FOR EVER Website. Purchase invoices will also be available in the "My Account" section on the Website for Customers who have identified themselves on the Website.
Who is Cybersource?
To fight against fraudulent activities over the Internet, information pertaining to the orders is controlled by the payment partner designated by MAKE UP FOR EVER: Cybersource, (a company registered in England and Wales, with company number 3425262 and whose registered address is at P.O. Box 8999, San Francisco, CA 94128-8999 USA) ("Cybersource"), which is a secure payment operator. This company is responsible for the automated storage and processing of information relating to each order, including bank card details, in a secure environment.
Information pertaining to the orders is subject to automated data processing, for which Cybersource is the manager. The purpose of this automated data processing is to define a level of analysis for transactions and to fight against fraud regarding payment methods, in particular credit card fraud.
Cybersource and MAKE UP FOR EVER are recipients of the data related to the Customer’s order. The non-transmission of the data related to the Customer’s order prevents the execution and analysis of the transaction.
Should any payment incident occur in connection with a fraudulent use of a credit card or any other method of payment, the data set out on the corresponding order shall be recorded in a “payment incident” file implemented by Cybersource. Any incorrect declaration or anomaly may also be subject to a specific treatment.
In accordance with the European Regulation 2016/679 of 27 April 2016 known as the General Data Protection Regulation (GDPR), the Customer has the right to access, modify and delete all his/her personal data at any time by writing to MAKE UP FOR EVER,

- using the form available on the Website by clicking on the "Contact Us" button
- or by writing at : MAKE UP FOR EVER Customer Service and E-commerce, 1 rue Pasquier, 92300 Levallois-Perret.
If at any time the server is unavailable MAKE UP FOR EVER will be unable to accept orders through the Website and accepts no responsibility to the Customer for his/her inability to make an order.
The Customer is informed that they may register on the French 'no telephone canvassing' list for free (www.bloctel.gouv.fr) .
9. DELIVERY
1. Delivery address
The Products ordered by the Customer in accordance with the present General Terms and Conditions of Sale will be delivered to the postal address indicated by the Customer as delivery address when placing his/her order.
Deliveries shall always be rejected if the delivery address indicated by the Customer corresponds to:
- a hotel or any other shelter;
- a remaining post;
- a PO Box;
- a non-fixed address or domicile (i.e., without this list being exhaustive, mobile homes, caravans, campsites, and other non-fixed debits) or in a collective place where an individual address cannot be assigned in such a way and durable to a natural or legal person.
2. Delivery time / Delivery costs
Delivery time and costs depend on the delivery method chosen by the Customer when ordering.
Delivery time shall begin when the order confirmation email is sent.
For any delivery, the Products are delivered by the carrier and the delivery costs are fixed at the amount stated on our Website from time to time. Each parcel contains a delivery voucher which mentions the conditions and possible ways to return the Products received.
10. RECEPTION OF THE PRODUCTS
On receipt of the Products, the Customer undertakes to check the good condition and conformity of packaging and the conformity of the Products delivered with the order and inform MAKE UP FOR EVER of any error, damage to packaging or non-arrival as soon as possible.
In the event of an error or irregularity concerning the delivery, especially deterioration or partial non-arrival of Products (missing Products comparing to MAKE UP FOR EVER’s invoice, delivery delay, etc.), the Customer shall indicate, at the receipt, his/her reserves by using the delivery slip given by the transporter, which will then be communicated to MAKE UP FOR EVER via email using the contact form available at www.makeupforever.com/eu/en/contactus or by phone at the following number: +33 1 41 43 13 19 within a maximum of ten (10) days counting from the receipt of the Products.
In the event that the Customer reported a missing product or a delivery delay, MAKE UP FOR EVER will make enquiry with the carrier.
In case of a missing product, should said product be found before the indicated delivery date, the product will be redirected to the delivery address specified in the order form.
If the order or the missing product has not been delivered after the indicated delivery date, for any other reason than a case of force majeure, the Customer shall write to MAKE UP FOR EVER by email using the contact form available on the Website by clicking on the "Contact Us" button; for the purpose of informing him of the delay and asking him to make the delivery, at the following address:

Should the delivery not be carried out within a reasonable additional period of time, the Customer may terminate the contract by registered letter with acknowledgement of receipt or in writing on any other durable support, at the same address. The Contract shall be deemed to be cancelled upon receipt by MAKE UP FOR EVER of the Customer's request informing of his/her decision (unless MAKE UP FOR EVER has performed in the meantime). In such a case, all the sums paid by the Customer (including delivery charges) will be returned to the Customer as a reimbursement as soon as possible and no later than fourteen (14) days from the date on which the Contract was cancelled.
11. RIGHT TO CANCEL AND PRODUCTS RETURN
According to the provisions of the European Directive n°2011/83/EU of 25 October 2011 related to consumer rights, for any reason whatsoever the Customer may exercise his/her right to cancel within fourteen (14) days from the date of the Customer’s receipt of the parcel with notice to MAKE UP FOR EVER to exercise his/her right of cancellation via an unambiguous declaration, including the reference and number of products returned by any means or via the cancellation form sent in the parcel or available on the Website at the following link: www.makeupforever.com/eu/en/login/
If MAKE UP FOR EVER sent multiple products from one order in separate parcels, these fourteen (14) days will start to run on the date the Customer receives the last parcel forming part of his/her order.
MAKE UP FOR EVER shall acknowledge receipt of the withdrawal without delay by sending an email to the Customer.
As from the notification of this right, the Customer has an additional period of fourteen (14) days to return, at his/her own expenses, the Product(s) he has ordered if the latter(s) do(es) not give him (them) satisfaction, and to cancel his order.
However, in accordance with the provisions of Article 16 of European Directive No. 2011/83/EU of 25 October 2011 related to consumer rights, the above-mentioned cancellation right shall not be applicable to Products tailored to the Customer’s specifications and/or which have been clearly personalized and/or unsealed, already used or bearing traces of use, for hygiene and health protection reasons.
The Customer must return the Products in perfect condition and in original packaging, unopened, so that the Products can be remarketed, following the procedure described on the delivery form attached to the parcel. The return costs shall be borne by the Customer, except in case of lack of conformity of the Products delivered with respect to the Order (in this case, the return costs will be borne by MAKE UP FOR EVER). MAKE UP FOR EVER does not accept parcels with postage due.
The Customer shall be responsible for any and all risks linked to the return of the Product(s). The Customer may follow his/her parcel via the tracking link sent in the Order confirmation email to avoid any inconvenience in case of loss or theft of the Products during the return transport.
If the above conditions are fulfilled, MAKE UP FOR EVER shall reimburse to the Customer the total amount paid at the order of the returned Products, using the same manner as the payment for the order, excepted the costs of return, within a maximum period of fourteen (14) days from receipt of the return voucher, or – at the latest – from the most recent of the following dates: the day on which MAKE UP FOR EVER receives the returned Products, or the day on which the Customer provides MAKE UP FOR EVER with proof of expedition of the Products concerned by the exercise of the Customer’s right to cancel, whichever of these days occurs first.
In the event that the Customer has expressly chosen a method of delivery more expensive than the standard delivery method proposed by MAKE UP FOR EVER when MAKE UP FOR EVER takes in charge reimbursement of the return delivery , the additional costs shall not be reimbursed and shall be borne by the Customer.
In case of a partial return of Products, the sole price of the returned Products shall be reimbursed by MAKE UP FOR EVER excluding the delivery costs, insofar as the Customer has benefited from the delivery service for the items kept and the delivery rates do not change depending on the volume ordered.
12. LEGAL GUARANTEE

The Customer has a period of two years from the date of delivery of the goods to invoke the legal guarantee of conformity in the event of a lack of conformity. During this period, the Customer is only required to prove the existence of the lack of conformity and not the date on which it appeared. When the sales contract for the goods provides for the continuous supply of digital content or a digital service for a period of more than two years, the legal guarantee applies to this digital content or digital service throughout the planned supply period. During this period, the Customer is only required to prove the existence of the lack of conformity affecting the digital content or digital service, and not the date on which it appeared. The legal guarantee of conformity requires the professional, where applicable, to provide all necessary updates to maintain the conformity of the goods. The legal guarantee of conformity entitles the Customer to have the goods repaired or replaced within thirty days of their request, free of charge and without any major inconvenience to them. If the goods are repaired under the legal guarantee of conformity, the Customer benefits from a six-month extension of the initial guarantee. If the Customer requests repair of the goods, but the seller imposes replacement, the legal guarantee of conformity is renewed for a period of two years from the date of replacement of the goods. The Customer may obtain a reduction in the purchase price while keeping the goods or terminate the contract for a full refund upon return of the goods if: 1° The professional refuses to repair or replace the goods; 2° The repair or replacement of the goods takes place after a period of thirty days; 3° The repair or replacement of the goods causes a major inconvenience to the Customer, in particular when the Customer definitively bears the costs of taking back or removing the non-conforming goods, or if they bear the costs of installing the repaired or replacement goods; 4° The lack of conformity of the goods persists despite the seller's unsuccessful attempt to bring them into conformity. The Customer is also entitled to a reduction in the price of the goods or to termination of the contract where the lack of conformity is so serious that it justifies the price reduction or termination of the contract being immediate. The Customer is then not required to request repair or replacement of the goods beforehand. The Customer is not entitled to terminate the sale if the lack of conformity is minor. Any period of immobilization of the goods for repair or replacement suspends the guarantee that remained to run until the delivery of the repaired goods. The rights mentioned above result from the application of Articles L. 217-1 to L. 217-32 of the French Consumer Code. A seller who obstructs in bad faith the implementation of the legal guarantee of conformity is liable to a civil fine of a maximum amount of 300,000 euros, which may be increased to 10% of the average annual turnover (Article L. 241-5 of the French Consumer Code) . The Customer also benefits from the legal guarantee against hidden defects under Articles 1641 to 1649 of the French Civil Code , for a period of two years from the discovery of the defect. This guarantee entitles the Customer to a price reduction if the goods are kept or to a full refund upon return of the goods. |
13. LIABILITY
MAKE UP FOR EVER shall only be held liable for due care. Only the Customer shall judge whether the Products ordered are appropriate and adapted to his/her needs and consumption.
MAKE UP FOR EVER shall assume no liability if the Customer uses the Product(s) without complying with their instructions for use.
Before placing an order, the Customer declares his/her full legal capacity entitling him/her to transact according to the present General Terms and Conditions of Sale. MAKE UP FOR EVER shall assume no liability as to the confirmation of the Customers or visitors’ legal capacity. As a result, if a person who does not have legal capacity orders Products on the Website, his/her legal guardians shall assume responsibility of such order and, and in particular honor its payment.
MAKE UP FOR EVER makes no warranties that the Website will be available on an uninterrupted, timely, secure or error-free basis. Especially, MAKE UP FOR EVER shall not be held liable for:
- Interruptions, malfunctions, or delays recorded on the Website due to technical failures, a case of force majeure, or because of third parties or any other circumstances beyond MAKE UP FOR EVER’s control;
- The impossibility or temporary inability for the Customer to access the Website, due to circumstances which are beyond MAKE UP FOR EVER’s control, such as computer breakdown, interruptions of the telephone network, the Internet, or the failure of the Customer's reception equipment for the Internet.

Without limiting any other provisions of the present General Terms and Conditions of Sale, MAKE UP FOR EVER shall only accept liability for a fault which is duly proven and exclusively attributable to MAKE UP FOR EVER. Liability is strictly limited to direct damages. MAKE UP FOR EVER reserves the right to suspend access to the Website at any time.

15. FORCE MAJEURE
MAKE UP FOR EVER shall not be held liable for improper performance or partial or total non-performance of the obligations hereunder, if this is due to the Customer, or any unforeseeable and unsurmountable act of a third party, or a case of force majeure as defined by caselaw. These events shall justify the interruption and/or extinction of MAKE UP FOR EVER’s obligations, without the Customer being entitled to any compensation or damages.
16. INTELLECTUAL PROPERTY RIGHTS
Any and all intellectual property rights attached to the Products presented for sale on the Website are and shall remain the exclusive property of MAKE UP FOR EVER. All rights are exclusively reserved. Therefore, no one is authorized to reproduce, exploit, disseminate or use in any way, even partially, said intellectual property rights, unless MAKE UP FOR EVER’s prior written consent has been obtained. MAKE UP FOR EVER 's trademarks and logos are registered trademarks. Consequently, any reproduction is an infringement.
17. ENTIRE AGREEMENT
The present General Terms and Conditions of Sale, the order summary communicated to the Customer and the order confirmation email constitute the entire agreement between the Parties. These are the sole binding and enforceable contractual documents between the Parties, excluding any other document or photograph of the Products which shall only be considered as indicative.
18. APPLICABLE LAW - LITIGATION
The present General Terms and Conditions of Sale and the contractual relationship between MAKE UP FOR EVER and the Customer shall be governed by the laws of France unless local law is of public order or more favorable to the Customer. All disputes or differences that may arise in connection with or in relation to these General Terms and Conditions of Sale, or in connection with the relationship between the Parties, shall be first submitted to a consumer mediator. Should no amiable settlement be reached, any disputes will be submitted to and definitively settled by the Courts of France.

19. NON-WAIVER
